Soft and blurry edged, data protection law is far from a clearly defined framework of authoritative rules and prohibitions. In this session, European intellectual and academic entrepreneur Paul De Hert discusses the lessons of legal anthropology for privacy and data protection, drawing on the works of Gustav Radbruch, Mary Douglas and Zygmunt Bauman. He explains why the elaborated codes of data protection are well adapted to a middle-class bourgeoisie, while restricted codes are better suited for a working-class, providing practical examples from issues such as facial recognition and possible improvements. Like any conversation with De Hert, this session will focus on understanding important ideas that might help privacy professionals understand diverging regulatory approaches.
